Breeding Contract ___________________________________________ This contract entered in to this _____ day of
________________ between Donald K. Godbee, hereafter referred to as Stallion
Owner, and ____________________, hereafter referred to as Mare Owner. 1. The stud fee for ________________________ a
______________________________ stallion, shall be $_____. This fee will
entitle Mare Owner to breed one mare to the stallion during the _____
breeding season. 2. A non-refundable $100.00 booking fee is to be
paid when Mare Owner signs Breeding Contract. A payment of $_____ is to be made when mare is delivered to the
Breeding Farm for service. Mare care fees of $___ per day are to be paid when
mare is retrieved by Mare Owner. 3. Stallion Owner warrants that no more than 25
breeding rights shall be sold in said year. 4. This certificate may be transferred to another
Mare Owner, prior to the designation of the mare to be bred, upon notifying
the Stallion Owner in writing. Mare Name And Registration Number:
______________________________________________________________________________________. 5. Any mare to be bred under this contract
must be healthy and in sound breeding condition and free from infection and
disease. Mare Owner must have a valid negative Coggins
report as well as an Equine Health Certificate prior to service. 6. Live Foal Guarantee: Should
the mare fail to produce a foal which stands and nurses, the Mare Owner shall
be entitled to rebreed the mare or a substitute mare for a period of one year
from the date of this agreement or the date of the loss of the foal.
There will be no additional stud fee for a rebreed, but all other veterinary
fees and mare care fees shall apply. Failure to notify MyWay Farm in a timely manner shall result in the loss of
the live foal guarantee and return privileges. This clause is also
binding in the case of an abortion. The Mare Owner fully understands,
authorizes, and assumes the special risk inherent in breeding. Mare Owner also understands the risk of
failure due to many variables and shall hold MyWay
Farm and the Stallion Owner harmless for any losses suffered due to an
unsuccessful attempt at conception. Donald K Godbee or any other person
associated with MyWay Farm shall not be liable for
the death, sickness and/or accident, including consequential damages caused
to the mare and/or foal, and mare owner agrees to hold Donald K Godbee or any other person associated with MyWay Farm harmless for any and all damages associated
herewith. 7. Mare Owner is bound by the normal rules,
regulations, and policies of the Breeding Farm and shall sign a farm breeding
contract when mare is delivered to be bred and assumes responsibility for all
veterinary expenses or related expenses that may occur during breeding. 8. This agreement constitutes the entire
agreement of the parties, and shall be binding on the parties, their heirs
and assigns, and personal representatives. The terms of this contract have been read and
